Terms of Use of the Logbook App
Last updated: 5 November 2026
1. Provider and scope
The Logbook App (the “App”) is provided by Florian Kriesche, Demollstraße 5, 80638 Munich, Germany, email: website@logbook-app.com (the “Provider”).
These Terms of Use apply to the use of the App on all platforms, both free of charge and with a subscription. They apply to consumers and to business users.
Downloads, purchases and payments are handled by the store from which you obtain the App (Apple App Store or Google Play). The terms of that store apply in addition; see section 12.
2. What the App is and what it is not
The App supports your daily record-keeping on board. Please note before first use:
- Not a substitute for a mandatory logbook. Using the App does not release you from keeping a logbook or ship's log where this is required by law, by the law of the flag state, or by insurance or charter terms. You are responsible for checking whether and in what form you are obliged to keep one.
- Not tamper-proof. Entries can be changed or deleted afterwards without this being visibly recorded. The records are therefore of limited or no use as evidence towards authorities, courts or insurers.
- Not a navigation or safety system. Position, course, speed, weather and map data may be inaccurate, incomplete or out of date. For navigation and vessel handling, rely on approved instruments, official nautical charts and good seamanship.
- Automatic recording without a guarantee of completeness. It depends on your device, operating system, battery, reception and the permissions granted, and it may be interrupted.
These characteristics form part of the agreed features of the App.
3. Licence
The Provider grants you a non-exclusive, non-transferable and non-sublicensable right to use the App for your own private or professional purposes on devices that you own or control. The usage rules of the relevant store apply in addition.
You may not
- copy, distribute, rent out or make the App publicly available,
- decompile or modify the App, except where the law expressly permits this,
- circumvent technical restrictions, in particular the limits of free use or the subscription check.
If you circumvent such restrictions, the Provider may block the affected features.
4. Free use
Most of the App can be used free of charge. Currently, once you have created more than 250 entries, automatic recording is only available with a subscription. The App shows the current scope of free use.
The free scope is provided voluntarily so that you can get to know the App. The Provider may change or restrict it for the future; there is no entitlement to a particular free scope. The Provider will announce material restrictions at least 30 days in advance in the App or on the website.
You can continue to view and export entries you have already saved without a subscription.
5. Subscription
- What you get: The subscription unlocks additional features. The App shows which features these are and what the subscription costs before you buy.
- Term and renewal: The term is one year. The subscription renews automatically for a further year each time unless you cancel in good time before it ends. The deadline of the relevant store applies, currently as a rule at least 24 hours before the end of the term.
- Cancellation: You cancel in the subscription settings of your store account. Deleting the App does not end the subscription.
- Price: The price shown by the store at the time of purchase applies, including any applicable taxes. Price changes for future terms are communicated to you through the store in line with its rules.
- Payment, refunds, withdrawal: Payment, billing and refunds are handled by the store. Statutory rights of withdrawal remain unaffected and are exercised through the store.
- Tied to your store account: The subscription is tied to the store account used to buy it. On another device on the same platform, you restore it using “Restore purchases”.
- After it ends: When the subscription ends, the subscription features are no longer available. Your entries are kept; you can continue to view and export them.
6. Earlier one-time purchases
If you bought the App as a one-time purchase before the switch to the subscription model on 31 March 2026 (iOS, version 2.83) or on 26 June 2026 (Android, version 1.29), you permanently keep, without a subscription, at least the range of features that was available to you at the time of the switch. This requires that you use the App with the store account used for the purchase.
Features added after the switch may require a subscription. Where the Provider makes such features available to earlier buyers without a subscription, this is voluntary and does not create an entitlement for the future.
7. Storage and synchronisation of your data
Your entries are stored locally on your device. If you enable it, they are also synchronised via a server operated by the Provider in the European Union. There are no user accounts.
Synchronisation is not a backup or archiving service and is provided without any promised availability. You are responsible for backing up your data, for example by exporting regularly or using a device backup.
How the Provider processes personal data is described in the Privacy Policy.
8. Map material and exports
The map material shown in the App comes from Apple (Apple Maps) or Google (Google Maps). The terms of the relevant map provider apply to its use.
Exports that contain map sections (for example PDF) are intended for your own records. You may publish or commercially exploit map sections only to the extent that the terms of the map provider allow. Your own entries belong to you.
9. Updates, changes and discontinuation of the App
Updates: Updates are provided through the store. If you do not install an update within a reasonable time after it is made available, the Provider is not liable for defects that result solely from this. The supported operating system versions may change.
Changes: The Provider may change the App beyond what is needed to keep it in conformity with the contract if there is a valid reason. Valid reasons include in particular adaptation to new operating systems, devices or store requirements, security, changes in the law, changes to third-party services (for example map or weather services), further development of the App and protection against misuse. This does not cause you any additional costs, and the Provider will inform you of the change clearly and comprehensibly.
If a change impairs the use of a running subscription more than insignificantly, the Provider will inform you in advance within a reasonable period. You may then end the subscription free of charge within 30 days and will receive a pro rata refund for the unused remainder of the term.
Discontinuation: The Provider may discontinue the App altogether and will, where possible, announce this at least three months in advance. Subscriptions will then no longer renew. For periods already paid for in which the subscription features can no longer be used, you will receive a pro rata refund.
10. Warranty
Your statutory rights in the event of defects apply; for consumers these are in particular the German provisions on digital products (sections 327 et seq. of the German Civil Code). The characteristics described in section 2 are not defects.
11. Liability
The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee given.
In cases of slight negligence, the Provider is liable only for breach of an essential contractual obligation. This is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely. In that case, liability is limited to the foreseeable damage typical for this type of contract.
Where you use the App free of charge, the Provider is liable only for intent and gross negligence, for defects fraudulently concealed, and for injury to life, body or health.
In the event of data loss, liability is limited to the effort that would have been needed to restore the data if you had made regular, appropriate backups. This does not apply in the cases set out in the first paragraph.
Otherwise, the Provider's liability is excluded.
12. Additional platform terms
Apple App Store: For versions of the App that you obtain from the Apple App Store, Apple's Licensed Application End User License Agreement applies in addition: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Apple's rights under that agreement remain unaffected. Between you and the Provider, these Terms of Use take precedence where they differ from that agreement and to the extent this is legally permitted.
Google Play: For versions of the App that you obtain from Google Play, the Google Play Terms of Service apply in addition in your relationship with Google.
Apple and Google are not the providers of the App and are not responsible for its content, maintenance or support.
13. Changes to these terms and transfer
The Provider may change these Terms of Use for the future. The current version is available on the website and in the App. The Provider will announce material changes at least 30 days before they take effect, in the App or on the website.
For a running subscription, changes apply only from the next renewal. They apply earlier only if they do not put you at a disadvantage or if they are required by law, by authorities or by store requirements.
The Provider may transfer the contract to a company that will operate the App in future and will announce this in advance. If you do not agree to the transfer, you may end a running subscription as of the date of the transfer and will receive a pro rata refund for the remainder of the term.
14. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, Munich is the exclusive place of jurisdiction.
The Provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision is invalid, the remaining provisions remain valid.
The German version of these Terms of Use is authoritative. Translations are provided for convenience only.
